University of Embu (UoEM) Chancellor, Prof Musili Wambua, has filed a case seeking to stop his arrest and prosecution over alleged issuance of bouncing cheques worth KSh20 million.
This is the second application that the varsity boss has filed.
A similar application was dismissed by the High Court after he failed to attend a hearing of the case.
He is seeking orders to restrain Cyrus Maina and Company Advocates and businessman Kennedy Ngumbau from seeking his arrest and prosecution.
“I have always been willing, ready and diligent to defend this suit as is demonstrable from our past attendances in court evident from the proceedings,” said Prof Wambua.
The court had issued orders on December 22 last year barring any arrest of the applicant arising from the dishonour of the cheques in issue following the suit.
However the orders stood discharged after the suit was dismissed. Mr Wambua now seeks to have the application reinstated and admitted for hearing immediately.
He also seeks to have orders issued by Justice Ochieng dismissing the application, be set aside.
