I’ve no choice but to let him serve the sentence, MP says after son sentenced to death

Matuga Member of Parliament Hassan Mwanyoha has indicated he will not appeal the death sentence issued against his son Mafanikio Mwanyoha who was found guilty of violently robbing a tourist in Diani, Kwale.

A judge in Kwale handed the sentence against Mafanikio and his accomplice Hussein Hassan last Wednesday.

Before the verdict, Mafanikio asked the court to forgive him, saying he was innocent: “I did not commit any offence as claimed. The court should just release me.”

Hassan said: “Let the court decide.”

Mafanikio and Hassan committed the offence on August 19th, 2015, at Bougan Villa Estate in Diani.

The two made away with Peter Schadwsky’s bag, an LG mobile phone, a pair of spectacles, a company ID card and five credit cards, all worth Ksh 14, 625.

Mafanikio’s father says he is left with no other option, but to accept the court’s verdict.

“He (Mafanikio) is over 18 years and is the one who knows best whether he committed the crime or not,” the legislator told journalists on Monday when he attended a harambee service at Tiwi Chai.

The MP’s son, however, has filed an appeal against the sentence. On Mafanikio’s move, MP Mwanyoha said: “Everybody has a right to appeal; it is his right.”

He, nonetheless, says he will wait for the outcome of Mafanikio’s appeal.

Mafanikio is facing another robbery with violence case at the Mombasa High Court. The case will be heard on May 30th.
